What’s the Word? ARBITRARY (and CAPRICIOUS)

Why? On June 18th, the Supreme Court ruled against the Trump Administration’s attempt to rescind DACA – the Obama Administration’s program to prevent the deportation of immigrants who were brought to America as children.

Chief Justice Roberts, writing for the majority, called the Administration’s move “arbitrary and capricious.”

Who? Cass Sunstein joins us to explain the deeper meaning of arbitrary, and its companion – capricious. Sunstein is a Professor at Harvard Law School, and author of perspective-changing books at the intersection of behavioral economics, law, and governance.
